Terms and Conditions
Terms and Conditions (T&Cs)
1. Scope of Application
These Terms and Conditions (T&Cs) apply to all orders placed by consumers and businesses through the online shop of
R.v.Klier Werkstoffprüftechnik
Owner: Martin Ziegner

A consumer, within the meaning of these T&Cs, is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
A business is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or profession.
These T&Cs apply equally to consumers and businesses, unless otherwise expressly stated in individual provisions.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but merely an invitation to place an order.
By clicking the “Buy Now” button, the customer submits a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept the order by sending an order confirmation via e-mail.
For custom-made products, special requests, or items not listed in the shop, the contract is only concluded once we have issued a written offer and the customer has accepted it. In such cases, the delivery times and conditions stated in the offer apply.
3. Prices and Shipping Costs
All prices are quoted in euros (€) and include the applicable statutory VAT.
The prices shown in the shop are final prices plus shipping costs.
The shipping costs are fixed and clearly stated during the ordering process.
We deliver within Germany, to all EU member states, as well as to Switzerland, Norway, and the United Kingdom.
For deliveries outside the EU, additional costs may arise (e.g. customs duties, taxes, or fees), which must be borne by the customer.
4. Delivery
Delivery within Germany usually takes 2–4 working days, provided the products are marked as “in stock.”
For deliveries to other European countries, delivery times may vary.
For custom-made products, special requests, or orders requiring prior quotation, delivery will take place within the period specified in the individual agreement.
If we are unable to deliver an item on time, we will inform the customer immediately.
5. Payment Methods
The following payment methods are available:
- Credit card
- Klarna
- Apple Pay
- Google Pay
- PayPal
- Bank transfer (prepayment)
Available payment methods may vary depending on the delivery country.
In the case of bank transfer, orders will be processed once payment has been received.
6. Right of Withdrawal
Consumers have the statutory right of withdrawal, as set out in the separately provided Right of Withdrawal Policy.
For business customers (B2B), the right of withdrawal does not apply.
7. Retention of Title
The goods remain our property until payment has been made in full.
For business customers, the following applies additionally:
We retain ownership of the goods until all claims arising from an ongoing business relationship have been settled in full.
The business customer is obliged to handle the goods with care as long as ownership has not yet passed to them.
8. Warranty and Liability
The statutory warranty rights apply.
For consumers, the warranty period is two years from delivery of the goods.
For business customers, the following applies:
- The warranty period is twelve months from transfer of risk.
- The business customer is obliged to examine the goods immediately upon receipt and to notify us of any defects without delay. If notification is not made, the goods are deemed to have been accepted.
We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are only liable for damages resulting from injury to life, body or health, and for breaches of essential contractual obligations (cardinal obligations).
9. Place of Jurisdiction and Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
For contracts with business customers, the place of jurisdiction is Düsseldorf, Germany.
Right of Withdrawal
Right of Withdrawal for Consumers
Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day
- on which you or a third party named by you, who is not the carrier, have taken possession of the goods, or
- in the case of multiple goods ordered in one order and delivered separately: from the day on which you or a third party named by you have taken possession of the last goods.
To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including the costs of delivery (except for additional costs arising from your choice of a different type of delivery than the standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal from this contract.
We will use the same means of payment that you used for the original transaction for this reimbursement, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts
- for the supply of goods which are not prefabricated and for the production of which an individual choice or decision by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
- for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
The right of withdrawal does not apply to entrepreneurs (B2B customers).
